Letters used to notify Tenderers at appropriate stages in an Open Procedure – Below EU Threshold.

Some letters have instructions. All the links below are Word Documents 

O.na.1 – Letter to a Tenderer eliminating them from the Tender competition on the basis that they have submitted a non-compliant Tender

O.na.1 – v1.0 10/06/13

O.na.2 – Letter to a Tenderer who has submitted an apparently Abnormally Low Tender requesting them to submit details of various aspects of their Tender

O.na.3 – Letter to a Tenderer eliminating them from the Tender competition on the basis that they have been deemed by the Contracting Authority to have submitted an ALT

Note: This letter may only be sent after the Contracting Authority has considered the constituent elements of the Tender.

O.na.4 – Letter to a Tenderer who has been identified as the Lowest Price/Most Economically Advantageous Tender requesting them to submit evidence in support of qualification criteria that they have declared to have met in their Tender submission

O.na.5 – Letter to a Tenderer eliminating them from the Tender competition on the basis that their documentary evidence failed to verify that they meet the pre-qualification criteria they declared to have met in their Tender submission

Note: This letter must be sent by the Contracting Authority at the same time as the Letter to Unsuccessful Tenderers for any period between notification and award to be valid.

O.na.8 – Notification of a Revision of Applicable Factor/Adjustment to the tendered Price previously notified

Note: This is an update sent to the successful Tenderer notifying of a revision to the Applicable Factor and the date of the Tender Inflation Indexation Date/adjustment to the tendered Price after the date of the Letter to Successful Tenderer and prior to the day which is the day before the date of the Letter of Acceptance.

Frameworks

Letters notifying tenderers that they have been awarded a place on a framework should follow the format of the Letter to Successful Tenderer, however Contracting Authorities must have regard to the call-off rules for the framework in question and additional information may be appropriate in certain cases. For example it may be appropriate to advise tenderers of their scores relative to the first ranked tenderer where the call off rules are based on rankings.
